Suspect cuts alleged home burglar with machete, Austin police say

The victim's injuries were so severe he needed surgery for stabilization.

AUSTIN — A 58-year-old man was arrested for allegedly threatening and injuring another man with a machete after he saw the victim at his home during a home invasion and burglary, according to Williamson County arrest documents.

Samuel Diaz is charged with aggravated assault with a deadly weapon -- a second-degree felony.

The assault followed after Diaz and his son reported to police that they were burglarized at their home by three men masked man on Jan 22, 2018. Diaz told police he believed the victim, who happened to be at the home at the same time as the burglary, was also a part of the scheme. Two days later, Diaz and his son claimed that the victim came back to their home and told them that he was not involved in the burglary.

According to the arrest documents, police also spoke with the victim who shared a different ending to the story.

The victim said he is an acquaintance of Diaz's son and had planned to go to his home to get a cigarette on Jan 22. While knocking on the door of the home, the victim said three masked men, who he didn't know, barged at Diaz's son. The victim said he didn't go inside of the apartment, and instead, walked away.

Two days later, the victim said Diaz and his son went to his apartment. Diaz allegedly grabbed the victim by his throat and pushed him back into his apartment and into a wall. The victim said Diaz threw him on the couch and pulled out a machete. The victim claims Diaz poked the machete at his upper chest -- leaving a shallow cut. The victim said the suspect then put the machete on his throat, causing him to fear for his life.

The victim said he grabbed the blade to keep the machete from cutting his throat, but he injured his finger in the process. The victim said the wound was so deep, his finger needed surgery for stabilization.

During the incident, the victim's roommate woke up and said he noticed the suspect's son, with a crazed look on his face, rummaging through his room. The roommate said he saw the suspect's son steal a bat and an Xbox console.

The victim told police he heard Diaz say "there are too many witnesses" before leaving his apartment.

Diaz is currently in the Williamson County Jail on a $100,000 bond.
